Terms and Conditions of Use

1. Acceptance of Terms

By accessing and using Social Rides (hereinafter “the Platform”), you agree to be bound by these Terms and Conditions of Use. If you do not accept these terms, please do not use the Platform.

We reserve the right to modify these Terms at any time. Modifications take effect upon publication on the Platform. Your continued use of the Platform after any modification constitutes your acceptance of the new terms.

2. Service Description

Social Rides is a social platform dedicated to cycling enthusiasts. It allows users to:

• Create and share cycling routes
• Discover new rides and itineraries
• Join and create cycling communities
• Participate in events and rides organised by other users
• Connect with other cycling enthusiasts

3. Registration and User Account

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current and complete information at registration
• Maintain and update your information to keep it accurate
• Keep your password confidential and secure
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activities carried out through your account

You must be at least 13 years old to create an account. Minors must obtain parental consent.

4. Platform Use

You agree to use the Platform only for lawful purposes and in a respectful manner. You agree not to:

• Post offensive, defamatory, illegal or inappropriate content
• Harass, threaten or intimidate other users
• Impersonate another person or entity
• Infringe the intellectual property rights of others
• Attempt unauthorised access to Platform systems
• Use bots, scripts or other automated means without authorisation
• Collect data from other users without their consent

5. User Content

You retain all rights to the content you post on the Platform (routes, photos, comments, etc.). By posting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify and display that content in the context of Platform operations.

You represent and warrant that:

• You are the owner or have the necessary rights to post the content
• The content does not infringe any third-party rights
• The content complies with these Terms and applicable legislation

We reserve the right to remove any content that violates these terms or that we deem inappropriate, without notice and at our sole discretion.

6. Intellectual Property

The Platform and its original content (excluding user content) are and remain the exclusive property of Social Rides. The Platform is protected by copyright, trademark and other intellectual property laws. You may not copy, modify, distribute or reproduce any element of the Platform without prior written authorisation.

7. Role of the Platform, Organisation of Rides and Liability

Host status: Social Rides is a technical intermediary within the meaning of Article 6 of French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN). We provide a connection and content-hosting service that allows users to publish, discover and join cycling rides and events. We are not subject to any general obligation to monitor the content published by users.

Social Rides is not the organiser: Social Rides does not organise and does not take part in the rides, routes and events announced on the Platform. These are created, organised and supervised exclusively by the users who publish them, under their sole and entire responsibility. A user who creates a ride acts in their own name, and not in the name of or on behalf of Social Rides. Social Rides exercises no control over how rides unfold, does not select participants and provides no supervision or oversight. Responsibility for the organisation, conduct and safety of rides lies exclusively with their organisers and participants.

Cycling practice: Cycling involves inherent risks. By using the Platform to discover or share routes, you acknowledge and accept these risks. You are solely responsible for:

• Your safety and that of others during your rides
• Assessing your physical capabilities before undertaking a route
• Complying with traffic laws and local regulations
• Using appropriate safety equipment (helmet, lights, etc.)
• Checking route conditions and weather conditions

Social Rides does not guarantee the accuracy, safety or suitability of routes shared by users. We disclaim all liability for accidents, injuries or damage occurring from the use of information found on the Platform.

8. Limitation of Liability

The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, Social Rides disclaims all warranties, express or implied, concerning the Platform. We do not guarantee that the Platform will always be available, secure, error-free or virus-free.

In no event shall Social Rides be liable for direct, indirect, incidental, special or consequential damages resulting from the use or inability to use the Platform.

9. Termination

You may delete your account at any time from your settings. We reserve the right to suspend or terminate your account, at any time and without notice, if we determine that you have violated these Terms or that your conduct is harmful to the Platform or other users.

10. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to the interpretation or performance of these Terms shall be subject to the exclusive jurisdiction of French courts, unless otherwise required by mandatory legal provisions.
